LFA Filmmakers' Club - Terms & Conditions

Welcome to the London Film Academy (LFA) Filmmakers’ Club. Membership is contingent on adherence to these Terms and Conditions, including the LFA Filmmakers’ Club Code of Conduct. 

1. Terms and Conditions

These terms (together with the documents referred to on it, which are hereby expressly incorporated) set out the Terms and Conditions of the LFA Filmmakers’ Club digital platform

(https://club.londonfilmacademy.com) and other associated online services accessed by LFA Filmmakers’ Club members, which are behind a password ('our /the/ LFA/Club site’) and applies to all users of and visitors to the site ('you'). Please read these Terms and Conditions carefully before you begin to use the site. By using the site, you indicate that you accept these Terms and Conditions and that you agree to abide by them. If you do not agree to these Terms and Conditions, please refrain from accessing, using and/or contributing to the site.

These Terms and Conditions may be amended at any time. Revised Terms and Conditions take effect immediately from the time they are published and continued use of the site will be deemed acceptance of updated or amended terms.

2. Information about us

The site is brought to you by London Film Academy (LFA). 

This service is operated under contract by Aluminati Network Group Ltd. (Aluminati) acting under instruction as our Data Processor under the Data Protection Act 1998. Aluminati will process personal data strictly for the purposes of operating this service.

Aluminati is registered with the Information Commissioner under membership number Z8393842.

3. Information we collect (privacy policy)

We process information about you in accordance with our Privacy Policy which forms part of these conditions. By using our site, you consent to such processing and warrant that all data you provide is true and accurate.

4. LFA Filmmakers’ Club Code of Conduct

As a member of the LFA Filmmakers’ Club you will;

  • treat other Club members with respect and dignity at all times in line with the LFA’s values of collaborative, innovative, sustainable, inclusive and impactful.
  • value and take pride in the diversity of our community.
  • while engaging in any Club activity, uphold the highest standards of personal conduct.
  • use the Club site in an appropriate manner, including communicating through the correct channels. All contact should be respectful and follow good communications etiquette and should adhere to these Terms and Conditions.
  • uphold and enforce this Code of Conduct and report any contravention or concerns to LFA via the appropriate channels (please see Contravention of Code of Conduct below).
  • ensure postings on the Club site forums do not breach any law or discuss how to commit illegal activity.
  • ensure all comments on the Club site are free of disability, race, gender, religion or sexual discrimination.
  • represent yourself accurately and not falsify information; this includes falsifying job status on your member profile.


Unacceptable behaviour includes, but is not limited to, the following:

  • verbal abuse
  • harassment or stalking
  • bullying
  • discrimination
  • racism
  • sexual harassment
  • unwanted physical contact.

5. Contravention of LFA Filmmakers’ Club Code of Conduct

Any suspected contraventions of the LFA Filmmakers’ Club Code of Conduct or any infringements related to the LFA Filmmakers’ Club digital platform in general should be reported in writing as soon as possible to clubsupport@londonfilmacademy.com or by contacting 020 7386 7711.

All comments and complaints will be treated with confidentiality, respect and equality.

6. Accessing our site

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential and you must not disclose it to any third party. LFA has the right to disable any identification code or password whether chosen by you or allocated by LFA at any time if in the LFA's opinion you have failed to comply with any of the provisions of these terms of use.

You are responsible for making all arrangements necessary for you to have access to the site. You are also responsible for ensuring that all persons who access the site through your internet connection are aware of these terms and that they comply with them.

Access to the site is always at our discretion and we may withdraw or amend the services provided on the site without notice. From time to time we may restrict access of some or all users to some or all parts of the site and sometimes the site may be unavailable. Whilst we aim to update our site regularly the content on our site may be out of date at any given time.

If we determine that you have breached any of these conditions, we may take such action as we deem appropriate, including disabling your password whether chosen by you or allocated by us. You agree to indemnify us for all claims brought by a third party against us arising out of or in connection with any breach by you of any term set out in these conditions.

7. Acceptable use

You may use the site only for lawful purposes. You must not use the site:

  • in any way that breaches any applicable local, national or international law or regulation (including applicable law in the UK and the law of the country from which postings are made);
  • in any way that is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect;
  • for the purpose of harming or attempting to harm minors in any way;
  • to send, knowingly receive, upload, download, use or re-use any material that does not comply with the content standards (see Section 10);
  • to transmit or procure the sending of any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam);
  • to knowingly transmit any data, send or upload any material that contains viruses or any other computer code, programs or files designed to destroy, interrupt or limit the functionality of any computer, computer software or hardware or telecommunications equipment.

8. Intellectual property rights

LFA is the owner or the licensee of all intellectual property rights in the site and in the material we publish on it (LFA published material). Those works are protected by copyright laws and treaties around the world. All such rights are reserved. LFA asserts its Moral Rights.

You must acknowledge our status and that of any identified contributors as the authors of such material. Nothing contained in the site shall be taken, construed or considered as a grant of licence or right to use the trademarks of the LFA or that of any third party displayed on the site without the prior written permission of the respective owner/s. Subject to statutory allowances, extracts of material from our site may be accessed, downloaded and printed for your personal and non-commercial use and you may draw the attention of others within your organisation to material posted on the site.

You may not modify the paper or digital copies of any material printed off or downloaded in any way and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

You must not use any part of the material on the site for direct or indirect commercial purposes or advantage without obtaining a licence to do so from LFA. 

If you print, copy or download any part of the site in breach of these terms of use, your right to use the site will cease immediately and you must at the option of LFA return or destroy any copies of the material you have made.

9. Making contributions to our site

In submitting a contribution to the site:

  1. You grant to LFA a non-exclusive, world-wide, royalty-free licence to copy, reproduce, broadcast, transmit, display and perform by all means all or part of your contribution on the site for the entire period of copyright in your contribution and all renewals, extensions or revivals thereof; and
  2. You warrant that:
    • Your contribution is your own original work or you have a licence from the author/s or copyright owner/s of the work granting LFA use of the work on the terms of the foregoing licence granted by you; and
    • You will comply with the Content Standards (below); and
    • Your contribution does not infringe the copyright or other intellectual property rights of any person or organisation, which includes your having obtained sufficient rights (by written permission/licence or consents as appropriate) for LFA to exercise the foregoing licence granted by you -
      • from rights holders of third party copyright materials that you may have included in your contribution in whole or in part, e.g. others' literary works, photographs or other artistic works, dramatic works, musical works, sound recordings, films or broadcasts, and/or that others' materials are used in your contribution under statutory (legislative) exemption such as fair dealing for the purposes of criticism or review, and
      • from all identifiable persons in any images or video/film and/or sound recordings that you may have included in your contribution (including parental/legal guardian consent for those under 16 and for those who are vulnerable adults).

 

10. Content Standards

These content standards apply to any and all material which you contribute to the site ('contributions') and to any interactive services or features associated with it, such as blogs, chatrooms, bulletin boards and wikis.

Contributions must:

  • Be accurate (where they state facts)
  • Be genuinely held (where they state opinions)
  • Comply with applicable law in the UK and the law of the country from which they are posted.

Contributions must not:

  • Contain any material that is likely to offend, provoke or attack other contributors to or users of the site
  • Contain any material that is defamatory of any person or entity
  • Contain any material that is obscene, offensive, abusive or hateful
  • Promote sexually explicit material
  • Promote violence or contain a statement or describe or encourage activities that could endanger the safety or well-being of others
  • Promote discrimination of the basis of age, sex, sexual orientation, disability, race, religion, or nationality
  • Infringe any copyright, trademark or other intellectual property right of any person or organisation
  • Advocate, promote or assist any unlawful act or illegal activity
  • Be made in breach of any legal duty owed to a third party such as a contractual duty or a duty of confidence
  • Be threatening, harass, abuse or invade another's privacy or cause annoyance, inconvenience or needless anxiety to any person
  • Be used to impersonate any person or to misrepresent the contributor's identity or affiliation with any person or organisation
  • Contain any material that contains viruses or any other computer code, programs or files designed to destroy, interrupt or limit the functionality of any computer, computer software or hardware or telecommunications equipment.

LFA reserves the right to review, edit or remove without warning any contribution that in its sole absolute discretion breaches these Content Standards and to take further action, including legal action, as LFA reasonably feels necessary or is required by law. Notwithstanding the foregoing, and to the fullest extent permitted by law, LFA accepts no responsibility or liability to any third party for the content or accuracy of any material posted by any user of the site.

11. Limitation of liability

LFA published material are provided on an 'AS IS' and 'AS AVAILABLE' basis. To the extent permitted by law, LFA excludes any representations or any warranties (whether express or implied by law), including the implied warranties of satisfactory quality, fitness of a particular purpose, non-infringement, compatibility, security and accuracy.

Unless material is part of LFA published material, or unless stated otherwise, the site may contain advice, opinions, statements or other information by various authors or organisations. Reliance upon any such advice, opinion, statement or other information is at your risk and to the extent permitted by law LFA disclaims all liability and responsibility arising from any reliance placed on such information by any user of the site or by anyone who may be informed of such information.

Where the site contains links to other websites and resources provided by third parties, those links are provided for information only. LFA has no control over the contents of those sites or resources and accepts no responsibility for them or for any loss or damage that may arise from your use of them.

In no event shall LFA be liable to any party for any of the following losses or damages (whether such losses be foreseen, foreseeable, known or otherwise): loss of data, loss of revenue or anticipated profits, loss of business, loss of opportunity, loss of goodwill or injury to reputation, wasted expenditure, loss suffered by third parties, any direct, indirect, special, incidental, or consequential loss or damages arising out of use of the site or reliance on any material or services provided in the site or accessed through it, whether or not amended by third parties and regardless of form of action.

Nothing in these terms of use is intended to exclude LFA’s liability for death or personal injury caused by LFA's proven negligence or fraudulent misrepresentation.

12. Trademarks

The name and logo of LFA are trademarks. You must not remove the the copyright or trademark notice(s) from any copies of any LFA published material.

13. Jurisdiction

These Terms & Conditions and all questions of construction, interpretation, validity and performance under these terms including non-contractual disputes or claims shall be governed by English law and subject to the exclusive jurisdiction of the English courts.

14. General

Nothing in these terms of use is intended to nor shall it confer any benefit on a third party whether under the Contracts (Rights of Third Parties) Act 1999 or otherwise.

LFA’s failure or delay to exercise or enforce any right in these terms of use does not waive LFA’s right to enforce that right.

If any of these terms and conditions should be determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any country in which these terms of use are intended to be effective, then to the extent and within that jurisdiction in which that term of use is illegal, invalid or unenforceable, it shall be severed and deleted from these terms of use and the remaining terms of use shall survive and remain in full force and effect and continue to be binding and enforceable.

Please email clubsupport@londonfilmacademy.com if you wish to- 

  • make a complaint about the club site,
  • report a contravention of the Code of Conduct or these Terms & Conditions.

We aim to respond to all complaints within three working days.
